1. All calls / SMSs are subjected to the Fair Use Policy of Phonon.
2. Service Terms
(a) Click-to-Call is provided by phonon as a hosted service to customers. By subscribing to the Phonon services, the customer agrees to indemnify phonon and its employees / associates against any claims for damages, losses etc. from advertisers and other third parties to / from whom the calls / SMSs have been generated.
(b) All hardware equipment, software licenses and intellectual property for provisioning this service will be the property of phonon. Customers, users of the services or any third party will not have any claim on these.
(c) The services provided by Phonon are dependent on other networks, and Phonon has no control over services failing due to limitations / inadequacies in PSTN or other networks.
(d) Services will be delivered as per phonon’s standard service delivery SLAs and service provisioning terms and conditions. We try to ensure a 98.5% uptime on our system on an annualised basis. However, we will not be responsibly in case the service goes down for a greater period of time.
(e) All calls / SMSs are subjected to the Misuse Control Policy of Phonon.
(f) Phonon is not a basic telephony service. Emergency calls will not be available on Phonon.
(g) Any user (subscriber who has purchased the account with Phonon) using the click-to-call services or any other services of phonon will be responsible for that call / it’s usage.
(h) Any User (subscriber who has purchased the account with Phonon) indeminifies and will hold phonon harmless against any civil or criminal usage of the click-to-call service from the user’s account.
(i) For statutory requirements, we will log user’s IP address, phone number and any other such information.
3. Any amount paid to us is neither refundable, nor transferable to another account under any circumstances.
4. Service tax (current rate: 10.3%), and other statutory levies, will be extra as applicable.

6. Invoicing shall be by our registered office at Baroda.
7. All disputes regarding the services provided by Phonon will be subject to jurisdiction of courts at Vadodara (India) only.
8. Phonon is not liable for damages due to acts of God, fire, weather, acts of governments or other authorities, wars, civil disturbances, riots, terrorist acts, strikes, thefts, pilferage, epidemics, quarantines, and other similar acts, incidents or force majeure beyond its reasonable control.
9. phonon reserves the right to change any of the terms and conditions of the services provided by it at any point of time.
10. By subscribing to click-to-call / phonon services, the customer agrees completely with the rates, terms and conditions and other details as listed in this document.
11. Confidentiality: Phonon will make all efforts to keep all information regarding its customers or calls made on behalf of the customer confidential. However, such information could be given by us to statutory, legal and audit agencies as required under the laws of the land.
12. Click4Calls is a service brand offered by phonon. All relationship / commercial engagement of the customer will be with phonon.in.
